By submitting media or placing an order with White Glove Memories, LLC (“Company”), you (“Customer”) agree to the following Terms of Service.
1. Scope of Services
White Glove Memories, LLC provides media digitization, transfer, scanning, and related archival services. Customer acknowledges that legacy and aging media may be fragile and content quality may be inherently limited by the condition of the original source material. The Company may assign or subcontract services. Work is performed in a professional manner consistent with industry standards.
2. Not an Insurer / Customer Assumption of Risk
The Company is not an insurer of Customer’s materials or content value. Fees are based solely on the value of services, not the sentimental or irreplaceable worth of materials. All materials are submitted and handled at the Customer’s risk.
3. Delivery, Turnaround & Performance
Delivery dates and turnaround times are estimates. The Company is not liable for delays caused by carriers, equipment issues, or events beyond reasonable control. Services are provided “as is,” without warranties to the fullest extent permitted by law.
4. Limitation of Liability
To the maximum extent allowed by New York law, liability for loss, damage, or destruction of materials is limited to the lesser of: (a) the amount paid by Customer for the order or (b) the replacement value of blank media of similar type. The Company is not responsible for consequential, incidental, emotional, or special damages.
5. Shipping to and from the Company
Customer is responsible for securely packaging and shipping materials. Risk remains with the Customer until received by the Company. When returned, risk transfers once delivered to carrier.
6. Digital Delivery, Hosting & Retention
If Customer selects digital delivery, they may receive a private access link. Anyone with the link may access the files. Third-party hosting platforms may be used and their security policies apply. Storage devices such as USBs or SSDs are for delivery only and are not guaranteed for permanent storage. Customers are responsible for creating backups. Working files may be retained for approximately 30–90 days, then may be permanently deleted.
7. Privacy, Confidentiality & Use of Media
Customer materials are treated as confidential. Media is not used for marketing without Customer consent. Authorized personnel may view media only as needed.
8. Copyright & Legal Responsibility
When you provide content to White Glove Memories, you specifically represent, warrant, and guarantee that one or more of the following is true: (1) You are the lawful owner of the content or otherwise have the legal right to duplicate, digitize, or transfer it; (2) You have a direct or implied license or permission from the copyright owner, or its authorized agent, to duplicate or transfer the content; (3) You have confirmed that the material is in the public domain; or (4) Your duplication and use of the material clearly falls within “fair use” as defined under the U.S. Copyright Act. You acknowledge that you are solely responsible for ensuring that duplication is lawful and agree to indemnify and hold White Glove Memories LLC harmless from any claims, damages, or expenses arising from copyright infringement, privacy violations, or unlawful content. White Glove Memories reserves the right to refuse any project believed to be unlawful or inappropriate.
9. Payments, Refunds & Acceptance
Payment terms apply as stated on orders or invoices. Refunds, if offered, are limited to service fees.
10. Governing Law
These Terms are governed by the laws of the State of New York. Any disputes shall be resolved exclusively in New York County, New York courts.
11. Consent
By using our services, the Customer agrees to these Terms of Service and the Company Privacy Policy.
